{"id":786,"date":"2015-05-13T04:01:28","date_gmt":"2015-05-13T04:01:28","guid":{"rendered":"http:\/\/asiattorney.amagumolabs.io\/overview-of-new-statutory-provisions-on-unemployment-insurance\/"},"modified":"2018-06-06T04:05:47","modified_gmt":"2018-06-06T04:05:47","slug":"overview-of-new-statutory-provisions-on-unemployment-insurance","status":"publish","type":"post","link":"https:\/\/www.asiattorney.com\/fr\/overview-of-new-statutory-provisions-on-unemployment-insurance\/","title":{"rendered":"Tour d\u2019horizon des nouvelles dispositions relatives \u00e0 l\u2019assurance ch\u00f4mage"},"content":{"rendered":"<p><strong>Qui est concern\u00e9 par l\u2019assurance ch\u00f4mage ?<\/strong><br \/>\nA l\u2019exception des personnes qui touchent une pension de retraite ou des personnes employ\u00e9es dans le secteur de l\u2019entretien et du m\u00e9nage, tous les salari\u00e9s qui travaillent en CDI ou en CDD, ainsi que les travailleurs saisonniers disposant d\u2019un contrat de travail d\u2019une dur\u00e9e sup\u00e9rieure \u00e0 3 mois et inf\u00e9rieure \u00e0 12 mois sont soumis \u00e0 l\u2019obligation d\u2019adh\u00e9rer \u00e0 l\u2019assurance ch\u00f4mage.<\/p>\n<p>Les employeurs concern\u00e9s sont (liste non exhaustive) : les agences et organisations \u00e9trang\u00e8res ainsi que les organisations internationales install\u00e9es sur le territoire vietnamien ; les entreprises, les coop\u00e9ratives, les entreprises familiales, ainsi que toute soci\u00e9t\u00e9 ou groupe de soci\u00e9t\u00e9s ; les entrepreneurs individuels qui emploient des salari\u00e9s.<\/p>\n<p>Chaque employeur doit prendre contact avec l\u2019organisme de s\u00e9curit\u00e9 sociale comp\u00e9tent pour mettre en place l\u2019adh\u00e9sion de son salari\u00e9 dans les 30 jours suivant le d\u00e9but du contrat de travail.<\/p>\n<p>Depuis le 1er janvier 2015, les entreprises de moins de 10 salari\u00e9s et leurs salari\u00e9s sont \u00e9galement soumis \u00e0 l\u2019obligation de cotiser \u00e0 l\u2019assurance ch\u00f4mage aux termes de la loi sur l\u2019emploi de 2013 et le D\u00e9cret n\u00b0 28\/2015\/ND-CP pris pour l\u2019application de la loi (ci-apr\u00e8s intitul\u00e9 le D\u00e9cret 28\/2015\/ND-CP).<\/p>\n<p><strong>Quelle est la r\u00e9partition entre les cotisations salariales et les cotisations patronales ?<\/strong><br \/>\nLes taux de cotisation sont r\u00e9partis ainsi :<\/p>\n<p>\u00e0     Les salari\u00e9s cotisent \u00e0 hauteur de 1% de leur salaire mensuel;<\/p>\n<p>\u00e0     Les employeurs doivent participer aux primes d\u2019assurance ch\u00f4mage \u00e0 hauteur de 1% de la somme des salaires mensuels des salari\u00e9s cotisant \u00e0 une assurance ch\u00f4mage.<\/p>\n<p>\u00e0     L\u2019Etat participera \u00e0 hauteur de 1% au fonds d\u2019assurance ch\u00f4mage par le biais de d\u00e9penses budg\u00e9taires visant \u00e0 soutenir le paiement de l\u2019assurance ch\u00f4mage des salari\u00e9s.<\/p>\n<p>Concernant les employ\u00e9s soumis \u00e0 un r\u00e9gime de cotisations \u00e0 l\u2019assurance ch\u00f4mage d\u00e9cid\u00e9 par l\u2019employeur (pour les entreprises \u00e0  IDE), le salaire mensuel qui doit servir de r\u00e9f\u00e9rence pour le calcul des cotisations ch\u00f4mage est celui utilis\u00e9 pour les cotisations sociales dans le cadre de la loi sur la s\u00e9curit\u00e9 sociale. Dans le cas o\u00f9 le salaire mensuel utilis\u00e9 pour le calcul de l\u2019assurance ch\u00f4mage est sup\u00e9rieur \u00e0 20 mois du salaire minimum applicable dans la r\u00e9gion, le salaire mensuel retenu pour le calcul des cotisations sera \u00e9gal \u00e0 ces 20 mois comme pr\u00e9vu par les dispositions du Code du travail.<\/p>\n<p><strong>Quelles sont les garanties offertes par l\u2019assurance ch\u00f4mage ?<\/strong><br \/>\nSi l\u2019employ\u00e9 remplit les conditions \u00e9nonc\u00e9es dans la loi sur l\u2019emploi de 2013, il aura le droit de b\u00e9n\u00e9ficier d\u2019une allocation mensuelle \u00e9quivalent \u00e0 60% de la moyenne des salaires mensuels vers\u00e9s au cours des 6 ant\u00e9rieurs \u00e0 la perte de l\u2019emploi. Cependant, le montant maximum ne pourra pas d\u00e9passer 5 fois le montant du salaire minimum de la r\u00e9gion concern\u00e9e selon le Code du travail.<\/p>\n<p>La dur\u00e9e d\u2019indemnisation est calcul\u00e9e en fonction de la dur\u00e9e de cotisation.  Pour 12 mois cotis\u00e9s, le salari\u00e9 ayant perdu son emploi touchera une indemnit\u00e9 ch\u00f4mage pendant 3 mois et ce dans la limite de 36 mois. Au-del\u00e0, le salari\u00e9 pourra pr\u00e9tendre \u00e0 un mois d\u2019allocation ch\u00f4mage suppl\u00e9mentaire pour 12 mois de travail.
